Intellectual Property / DMCA Policy

1. Our Commitment
Lusso Rinnato respects the intellectual property rights of others and prohibits the listing or sale of counterfeit, replica or otherwise infringing Products on its platform. Brand owners, rights holders and their representatives may report suspected infringement through the process below.
2. How to Submit a Notice
Send your notice to ip@lussorinnato.com. The notice must include:
- Your full name, address, telephone number and email.
- Identification of the trademark, copyright or other right that you believe is infringed (registration numbers where available).
- A direct URL to each allegedly infringing listing on the platform.
- A description of why the listing is infringing (e.g. counterfeit, unauthorised photograph, trademark misuse).
- A statement, made under penalty of perjury, that you are the rights holder or authorised to act on the rights holder’s behalf, and that the information in the notice is accurate.
- Your physical or electronic signature.
Incomplete notices may be rejected or held for clarification.
3. Our Response
- We acknowledge complete notices within two (2) business days.
- If the notice is well founded, we will typically remove or disable the listing within five (5) business days, notify the Seller, and (for repeat offenders) terminate the Seller’s account.
- We may retain a record of the notice and our action for our own compliance purposes.
- For high-volume rights holders, we offer dedicated escalation contacts — ask about our brand-protection programme.
4. Counter-Notice (Sellers)
A Seller whose listing has been removed and who believes the removal was the result of mistake or misidentification may submit a counter-notice to ip@lussorinnato.com. The counter-notice must include:
- The Seller’s name, address, telephone number and email.
- Identification of the listing that was removed.
- A statement, made under penalty of perjury, that the Seller has a good-faith belief that the listing was removed as a result of mistake or misidentification.
- The Seller’s consent to the jurisdiction of Delaware, United States courts (or, for non-residents, the courts where the Seller is located).
- The Seller’s physical or electronic signature.
Where applicable law permits, we may forward the counter-notice to the complainant and restore the listing after a ten (10) business day waiting period, unless the complainant files proceedings.
5. Misuse of this Process
Submitting a knowingly false or misleading notice is a serious matter. Persons or entities that abuse this process may be liable for damages, including costs and attorneys’ fees, under applicable law.
